Article 1 – Definitions

In these conditions, the following terms are understood to mean:

  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal
  • Consumer: the natural person who is not acting in the exercise of a profession or business
  • Day: calendar day
  • Durable data carrier: any means by which information can be stored for future use
  • Right of withdrawal: the possibility for the consumer to withdraw from the agreement within the cooling-off period
  • Entrepreneur: BY DANIEK FASHION
  • Distance contract: an agreement concluded via the internet

Article 3 – Applicability

These general terms and conditions apply to every offer and every agreement between the entrepreneur and the consumer.

Article 4 – The offer

The offer contains a clear description of the products. Obvious mistakes or errors are not binding on the entrepreneur.

Images are as true to life as possible, but colors may differ from reality.

All prices include VAT and exclude shipping costs, unless otherwise stated.

Article 5 – The agreement

The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions.

The entrepreneur confirms the order by e-mail.

Article 6 – Right of withdrawal

The consumer has the right to dissolve the agreement without giving reasons within 14 days of receipt.

After a notification of withdrawal, the consumer has another 14 days to return the product.

During the cooling-off period, the consumer must handle the product with care.

Article 7 – Costs in case of withdrawal

The costs for return shipment are for the account of the consumer.

The entrepreneur will refund the full purchase amount including standard shipping within 14 days, provided the product has been received.

Article 8 – Exclusion of the right of withdrawal

Exclusion of the right of withdrawal is possible for:

  • Personalized products
  • Hygienic products of which the seal has been broken (such as earrings)

Article 9 – The price

Prices will not be increased after the conclusion of the agreement, unless legally required.

Obvious errors in prices are not binding on the entrepreneur.

Article 10 – Conformity and warranty

The entrepreneur guarantees that products comply with the agreement and normal expectations.

No warranty for:

  • normal wear and tear
  • damage due to use
  • damage due to washing contrary to the washing label
  • influences such as water, perfume, or chemicals

Article 11 – Delivery

Delivery takes place at the address provided by the consumer.

The entrepreneur strives to deliver orders within 30 days.

The risk of damage or loss lies with the entrepreneur until the moment of delivery.

Article 12 – Payment

Payment must be made via the offered payment methods.

Article 13 – Complaints

Complaints must be reported by email within a reasonable period.

The entrepreneur will respond within 14 days.

Article 14 – Disputes

All agreements are subject to Dutch law.

How did ByDaniek come about?

My name is Daniek Hettema, I am 21 years old and the founder of By Daniek together with my mother Anita Hettema.

In November 2023, what started as a small idea, without clear plans — but with a great passion for fashion.
By Daniek quickly grew into something much bigger. In March 2024, we opened our first physical store in Bathmen, where we lovingly stayed for a year.
We soon noticed that By Daniek kept growing — and that called for a next step. Since February 2025, we have been located in Deventer, on Broederenstraat, where we have proudly further expanded our store.
Together, we carefully curate our collections. At By Daniek, you'll find fashion, accessories, and jewelry for a wide target audience — from young adults to older — always focusing on style, quality, and wearability.
A good price-quality ratio is very important to us. We ensure that our items remain affordable, so you can treat yourself — or someone else — a little more often.
